Reading Deconstruction and Differance as a Possibility in a Postmodern Understanding of Law
Law, passing the mediation of language, can be thought as the state of being on the way to reach the idea of justice in main, despite its whole speculative nature. In this state of being on the way, the postmodern senses of law regard it impossible to reach the idea of justice within the concept of abstract and general modern law senses which work with categories having stable meanings /concepts. Therefore, their primary purpose in this way is to separate law from abstract rules and to put it into operation in an attempt to make it resistant to rules. The senses of postmodern law generally tend to deconstruction, a lingual operation, in order to achieve this and aim to reveal conceptual / semantic contradictions which are specific to judicial norms/ categories under discussion. The main purpose of this is to show that only one meaning of these contradictions is arbitrarily taken to the center. Différance, closely related to deconstruction, is a concept pointing to language’s structure to postpone the meaning as a ground making the lingual play. Contextuality is the only place to catch both the meanings referring to semantic differentiation, not being identical, and difference of différance and the meanings referring to semantic retardation, postponement and backup. Our study, after opening these two concepts confronting us in postmodernism, aim to regard the law together with them and to reveal the opportunities that they present and will present in achieving the idea of justice within the sense of law to be accepted as postmodern.
