John Stuart Mill and His Influences on Legal Theory

Abstract

John Stuart Mill (1806-1873) was one of the best-known members of utilitarian philosophy with Jeremy Bentham and also a key figure of classic liberal thought. The relationship between liberalism and utilitarianism has been always characterized as a certain ambivalence; and this problematic nexus is naturally reflected on Mill’s philosophy under the thumb of two prominent concepts: utility and liberty. But because of the complex nature of this nexus, Mill’s philosophy becomes an important source for contemporary discussions in legal theory; especially on the limits of individual liberty, legal moralism, and legal paternalism. This article will examine Mill’s contributions to legal philosophy.
